Terms of Service.

Agreement to Terms

By accessing and using thefirstheadshot.com and the services provided by The First Headshot (a service of Marquel Yvette Photography LLC — collectively "we," "us," or "our"), you ("client" or "you") agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not use our services.

Services Provided

The First Headshot provides a single professional headshot photography product designed for students applying to ERAS, law firms, MBA programs, and competitive internships. The standard package includes:

• A 20-minute studio session in South Riding, VA
• One (1) retouched final image
• Delivery within 48 hours of the session, in the file formats requested (including AAMC 2026 MyERAS spec if needed)
• Coaching throughout the session

Additional retouched images from the same session are available at $100 per image. Pricing and inclusions in effect at the time of booking govern your session.

Booking and Payment

• Full payment is required at the time of booking to secure your session date
• Payment is processed by our booking provider (GoHighLevel / LeadConnector HQ)
• Cancellations made with less than 48 hours' notice are non-refundable
• No-shows are non-refundable
• One reschedule is permitted with at least 24 hours' advance notice
• Late arrivals may result in shortened session time without refund

Client Responsibilities

As a client, you agree to:

• Arrive on time for your scheduled session
• Follow preparation guidelines provided in your prep guide
• Respect our studio space and equipment
• Provide accurate contact and billing information
• Communicate any special requirements in advance

Minors and Model Releases

If any person under 18 is photographed during a session, a parent or legal guardian must be present and provide written consent. By booking a session that includes a minor, you represent that you have legal authority to consent on their behalf.

Clients grant The First Headshot a non-exclusive license to use delivered images for portfolio and marketing purposes unless the client opts out in writing before or at the session. A separate written model release is required for any use beyond portfolio and marketing.

Retouching and Editing

Standard retouching includes color correction, exposure adjustment, skin smoothing, and minor blemish removal. Requests for advanced edits (body reshaping, major background changes, removal of tattoos or jewelry, or adding/removing people from an image) may incur additional charges and are evaluated on a case-by-case basis. Reshoot sessions are not included with the standard package and are offered only at our discretion.

Copyright and Usage Rights

• The First Headshot / Marquel Yvette Photography LLC retains copyright to all images created
• Clients receive a license to use delivered images for personal and professional purposes (LinkedIn, application portals, firm directories, ERAS uploads, and similar)
• Images may not be resold, materially altered for commercial use, or used in violation of this agreement
• We reserve the right to use images for portfolio and marketing unless otherwise agreed in writing

Image Delivery

• Edited images are delivered within 48 hours of the session (standard turnaround)
• Images are delivered via secure online gallery or email link
• It is the client's responsibility to download and back up delivered images
• We are not responsible for lost or corrupted files after delivery

Cancellation and Rescheduling

• Cancellations made at least 48 hours in advance: full refund
• Cancellations within 48 hours: non-refundable
• Rescheduling: permitted once with at least 24 hours' notice, subject to availability
• No-shows: forfeit all payments

Force Majeure

Neither party shall be liable for delay or failure to perform obligations under these Terms due to events beyond reasonable control, including natural disasters, civil unrest, public health emergencies, government orders, utility or internet outages, equipment failure, serious illness or injury, or venue closures. In such cases, we will make reasonable efforts to reschedule the affected session at no additional charge.

Limitation of Liability

The First Headshot is not liable for:

• Equipment failure or technical difficulties
• Events beyond our reasonable control
• Indirect, incidental, or consequential damages
• Loss of images due to client error or third-party services after delivery

Our total liability shall not exceed the amount paid for services.

Indemnification

You agree to indemnify, defend, and hold harmless The First Headshot, Marquel Yvette Photography LLC, its owner, employees, and contractors from any claims, damages, liabilities, costs, or expenses (including reasonable attorney fees) arising from: (a) your use, distribution, or modification of delivered images; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you provide to us in connection with the session.

Dispute Resolution

The parties agree to first attempt to resolve any dispute through good-faith negotiation. If unresolved within thirty (30) days of written notice, the dispute will be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, held in Loudoun County, Virginia. Judgment on the arbitration award may be entered in any court of competent jurisdiction. Either party may seek injunctive or equitable relief in a court of competent jurisdiction located in Loudoun County, Virginia, without first engaging in arbitration.

Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles.

Severability

If any provision of these Terms is found unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.

Changes to Terms

We reserve the right to modify these terms at any time. Continued use of our services after changes constitutes acceptance of the modified terms.
